"Appeal ought to be dismissed as the lawsuit filed against Tan Sri Shukry was unsustainable"


Our Partner, Farah Shuhadah Razali and Associate, Ng Ying Ci from our Litigation practice group acted for Tan Sri Shukry Mohd Salleh, the former Chairman of Bank Rakyat, before the Court of Appeal in an appeal by JR Deepak Jaikishan, his brother and their company to reinstate their lawsuit against Tan Sri Shukry, Najib Razak, his wife Rosmah Mansor and two others over an alleged claim of conspiracy, fraud, malfeasance and abuse of process.

Their lawsuit was previously struck out by the High Court on 13 January 2020 following applications filed by Tan Sri Shukry, Najib Razak, his wife Rosmah Mansor and two others respectively.

Farah argued that the appeal should be dismissed as the lawsuit filed against Tan Sri Shukry was unsustainable.

The Court of Appeal found that there was no linkage between Tan Sri Shukry and the alleged claims and accordingly dismissed the appeal with costs of RM20,000.00 to be paid to Tan Sri Shukry.
