"The Suit against SPAN was untenable since the incidents leading up to the water disruptions were out of SPAN’s jurisdiction and/or control"


Our Partner, Farah Shuhadah Razali and Associate, Ng Ying Ci from our Litigation practice group acted for Suruhanjaya Perkhidmatan Air Negara (SPAN) in a class action filed by the Member of Parliament for Wangsa Maju together with 809 other residents around Wangsa Maju area. The suit was in relation to the water disruptions in 2019 that lasted four days.

The plaintiffs were seeking a court declaration that SPAN, the Federal Government, Government of the State of Selangor and several other public authorities were liable for negligence as they had breached their statutory duties in not maintaining water quality and/or in preventing the water disruptions.

Farah argued that the incidents leading up to the disruptions were not within SPAN’s jurisdiction or control and that the Plaintiffs had no legal standing to file the suit against SPAN specifically. Farah successfully managed to have the suit struck out as against SPAN.
