Our Litigation Partners, Idza Hajar Ahmad Idzam and Nan Muhammad Ridhwan together with their Legal Associates, Muhammad Hibri and Aiesyah Mustafa from Zul Rafique & Partners’ Litigation Practice Group had on 29.5.2024, acted for Malaysia Airlines Berhad (“2nd Defendant”) and succeeded in resisting an Erinford Injunction Application filed by Asia Pacific Higher Learning Sdn. Bhd. (“Plaintiff”).


On 16.1.2019, the 2nd Defendant being a master tenant, obtained a Judgement to demand vacant possession of the premises from its tenant (“Judgement”). On 26.1.2024, the Plaintiff being the sub-tenant of the premises, filed an Erinford Injunction Application to inter alia, restrain and prohibit the 2nd Defendant from filing any execution proceedings based on the Judgement in demanding vacant possession of the premises from the Plaintiff. It was submitted and accepted by the Court that:-

(i) 
The landlord of the premises has expressed that it does not wish to grant any forms of tenancy towards the Plaintiff;

(ii) 
The Plaintiff has already agreed to liaise with the 2nd Defendant to deliver vacant possession of the premises;

(iii) 
In the circumstances above, the status quo cannot be maintained. The Plaintiff has no right to continuously occupy the premises which renders the Erinford Injunction to be dismissed.

The Court agreed with the 2nd Defendant’s submission and the Plaintiff’s Erinford Injunction Application was dismissed with costs.
