We acted for Tenaga Nasional Berhad in this claim of unfair dismissal filed by a former employee of 21 years.

We were successful in this case against the employee as the Industrial Court emphasized that the repayment of the amount taken by the Claimant did not weaken the basis of the dismissal by the Company as it would be unhealthy labour practice to allow employees who had taken Company monies to return them in order to avoid dismissal. This employee was dismissed even though she had 21 years of service with no previous record of misconduct.

The Industrial Court upheld the dismissal as fair.
