ZUL RAFIQUE & partners successfully defends TM in the first access dispute decided by the Malaysian Communications and Multimedia Commission pursuant to Chapter 7 of the Communications and Multimedia Act 1998

Our partners, Darren Kor Yit Meng and Kuhendran Thanapalasingam and Associates, Daniel Lau and Jasmeet Kaur has successfully defended Telekom Malaysia Berhad in an access dispute initiated by YTL Communications Sdn Bhd (YTL) before the Malaysian Communications and Multimedia Commission (MCMC) pursuant to Chapter 7 of the Communications and Multimedia Act 1998 (CMA).

The access dispute is in relation to the provision of various services listed in the Commission’s Determination on Access List, Determination No. 2 of 2015 (Access List) and we successfully defended TM on all 5 issues raised by YTL. The decision provides further clarity on the scope and parameters of the Access List and the Commission’s Determination on Mandatory Standard on Access Pricing, Determination No.1 of 2017.

This was the first access dispute formally decided by MCMC pursuant to Chapter 7 of the CMA. The formal decision issued on 5 December 2019 is now available on the MCMC website. Please click here for the full decision.
