Our partner, Natalia Izra Nasaruddin and associate, Ng Ying Ci have successfully struck out a civil suit initiated by Radiant Splendour Sdn Bhd, Deepak Jaikishan and Rajesh A/L Jaikishan against Tan Sri Shukry Mohd Salleh, the former Chairman of Bank Kerjasama Rakyat Malaysia Berhad.

The suit was initiated against Tan Sri Shukry as the 5th Defendant alleging him to have conspired with the other Defendants namely, Dato’ Seri Mohd Najib Rajak, Datin Seri Paduka Rosmah Mansor, Dato’ Ahmad Johari Abdul Razak and Dato’ Seri Panglima Abdul Azeez to commit fraud as well as abuse of power.


An application to strike out the suit was filed premised on, amongst others, the ground that Tan Sri Shukry was wrongly sued as at all material time, he did not carry out the functions of the Chairman of Bank Rakyat. Upon hearing parties’ oral submissions, the Court allowed the said application with costs of RM10,000.00 to be paid by the Plaintiffs to Tan Sri Shukry.

The formal decision was given on the 13th of January 2020. As of 22nd January 2020, the Plaintiffs have notified the Defendants of their intention to appeal the matter to the Court of Appeal.
